Terms & Conditions

Please read these terms carefully before using our services.

Introduction

These Terms and Conditions (“Terms”) govern your use of the services provided by Chef Staffing Solutions, a trading name of HCC Temps Ltd, registered in England and Wales (“CSS”, “we”, “us”, or “our”).

By engaging our services — whether as a venue client, hospitality business, or candidate seeking placement — you agree to be bound by these Terms in full. If you do not accept these Terms, you must not use our services.

We reserve the right to update these Terms at any time. Continued use of our services following any update constitutes acceptance of the revised Terms.

Definitions

Throughout these Terms, the following definitions apply:

  • “CSS” refers to Chef Staffing Solutions, a trading name of HCC Temps Ltd.
  • “Client” or “Venue” refers to any business, individual, or organisation that engages CSS to supply staffing solutions.
  • “Candidate” or “Worker” refers to any chef, hospitality professional, or other individual registered with CSS for placement.
  • “Placement” refers to any temporary or permanent engagement of a Candidate with a Client arranged by CSS.
  • “Assignment” refers to a specific period of work undertaken by a Candidate at a Client’s premises.
  • “Engagement” means any direct or indirect use of a Candidate’s services by a Client, whether on a temporary, permanent, or self-employed basis.

Our Services

CSS provides specialist staffing and recruitment services for the UK hospitality industry, including but not limited to:

  • Temporary and relief chef placements
  • Permanent chef and hospitality recruitment
  • Front of house, bar, and kitchen support staff
  • Event and private chef sourcing
  • Emergency and same-day placements

CSS acts as an employment business (for temporary placements) and as an employment agency (for permanent placements) as defined under the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003.

CSS does not guarantee the availability of any specific Candidate and reserves the right to withdraw any Candidate from an Assignment at any time where it considers this to be in the best interests of either party.

Obligations of Venues

By engaging CSS as a Client, you agree to the following:

Health & Safety

You must provide a safe working environment for all Candidates in compliance with applicable UK health and safety legislation. This includes providing appropriate inductions, equipment, and supervision.

Accurate Briefing

You must provide CSS with accurate and complete information regarding the nature of the role, the working environment, hours of work, any hazards, and any skills or qualifications required.

Non-Solicitation

You agree not to directly engage, employ, or contract any Candidate introduced to you by CSS without CSS’s prior written consent and the payment of any applicable introduction or transfer fee. This restriction applies for a period of 12 months following the end of any Assignment.

Supervision

You are responsible for the day-to-day supervision and management of Candidates during an Assignment. CSS is not responsible for the acts or omissions of Candidates while on Assignment.

By registering with CSS, you agree to:

  • Provide accurate and up-to-date information regarding your qualifications, experience, right to work, and availability.
  • Notify CSS immediately of any change in circumstances that may affect your eligibility to work.
  • Conduct yourself professionally and in accordance with the Client’s reasonable instructions during any Assignment.
  • Comply with all applicable food safety, hygiene, and health & safety regulations.
  • Submit accurate timesheets in a timely manner as directed by CSS.
  • Not misrepresent your skills, experience, or certifications to CSS or to any Client.

CSS reserves the right to remove any Candidate from its register at any time, without notice, where it deems this appropriate.

Fees & Payment

Temporary Placements

Clients will be charged an all-inclusive hourly rate as agreed at the time of booking. This rate covers the Candidate’s pay, employer’s National Insurance contributions, holiday pay, and pension contributions. No additional charges will be applied unless otherwise agreed in writing.

Permanent Placements

A placement fee will be agreed with the Client prior to commencement of the recruitment process. This fee is payable upon the Candidate’s first day of employment with the Client.

Payment Terms

Temporary

Invoices issued weekly. Payment due within 14 days of invoice date.

Permanent

Invoice issued on start date. Payment due within 14 days of invoice date.

CSS reserves the right to charge interest on overdue invoices at a rate of 8% per annum above the Bank of England base rate, pursuant to the Late Payment of Commercial Debts (Interest) Act 1998.

Refund & Rebate Policy (Permanent Placements)

Where a permanently placed Candidate leaves employment or is dismissed (for reasons other than redundancy) within the first 12 weeks, CSS will, at its discretion, offer a partial rebate or a free replacement search in accordance with its rebate schedule, provided the Client’s account is in good standing.

Temporary Placements

CSS supplies temporary workers as an employment business. The following terms apply specifically to temporary Assignments:

  • All temporary Candidates remain employed by or engaged through CSS for the duration of any Assignment.
  • Clients must not make any payments directly to Candidates. All remuneration is handled by CSS.
  • Clients must verify and sign off timesheets accurately. Signed timesheets constitute acceptance of the hours worked and the charges arising.
  • Cancellation of a confirmed booking within 4 hours of the Assignment start time may result in a cancellation charge equivalent to 4 hours’ work at the agreed rate.
  • CSS does not warrant that any particular Candidate will be available for the full duration of an Assignment.

Permanent Placements

Where CSS introduces a Candidate who is subsequently engaged on a permanent basis, the following applies:

  • A placement fee is payable as per the agreed schedule, regardless of whether the role was altered from the original brief, provided the Candidate was introduced by CSS.
  • If a Client engages a Candidate introduced by CSS within 12 months of that introduction, a placement fee will be due even if no formal recruitment process was initiated.
  • CSS makes reasonable efforts to verify Candidate references and qualifications but cannot guarantee their accuracy. The Client is responsible for conducting its own due diligence.

Conduct & Performance

CSS expects all Candidates to maintain high professional standards. Clients are encouraged to provide prompt feedback to CSS if a Candidate fails to meet expectations.

Where a Client wishes to end an Assignment early due to concerns regarding a Candidate’s conduct or performance, they must notify CSS as soon as reasonably practicable. CSS will endeavour to provide a replacement Candidate where possible.

CSS operates a zero-tolerance policy towards discrimination, harassment, and unsafe working practices, applicable to both Clients and Candidates. Any breach of this policy may result in immediate termination of the working relationship.

Limitation of Liability

To the fullest extent permitted by law:

  • CSS’s total liability to any Client or Candidate shall not exceed the total fees paid to CSS in the three months preceding the claim.
  • CSS shall not be liable for any indirect, consequential, special, or punitive losses, including but not limited to loss of profits, revenue, reputation, or business opportunity.
  • CSS shall not be liable for the acts, omissions, negligence, or misconduct of any Candidate while on Assignment.
  • CSS does not exclude liability for death or personal injury caused by its own negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

Intellectual Property

All content, materials, and intellectual property on the CSS website and in our marketing materials — including but not limited to text, graphics, logos, and software — remain the property of HCC Temps Ltd and may not be reproduced, distributed, or used without our prior written consent.

Candidate CVs and profiles submitted to CSS remain the property of the respective Candidate. CSS is granted a non-exclusive licence to use such materials for the purpose of facilitating placements.

Data & Privacy

CSS processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. By using our services, you consent to CSS processing your personal data as described in our Privacy Policy.

CSS will not share your personal data with third parties except where necessary to fulfil our services, comply with legal obligations, or where you have provided explicit consent.

Candidates and Clients have the right to access, rectify, or request deletion of their personal data. Requests should be submitted to [email protected].

Termination

Either party may terminate its relationship with CSS by providing written notice. Any outstanding fees, charges, or obligations arising prior to the date of termination shall remain due and payable.

CSS reserves the right to immediately suspend or terminate services to any Client or Candidate who breaches these Terms, engages in unlawful conduct, or acts in a manner that CSS deems detrimental to its reputation or the welfare of its staff.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
